Amazingly, Briatore still has the right to take 20 per cent of Piquet Jnr's earnings over the next 15 years.
The Italian was forced to quit this week for telling Piquet Jnr to crash in Singapore last year to help team-mate Fernando Alonso to victory.
But Piquet Snr - who blew the whistle on the race- fix scandal - now wants to free his son from the clutches of Briatore, who still acts as a manager for several drivers.
The three-time world champ said: "I could not talk to other team members about the contract because Nelsinho was working for Flavio and his management has a contract with the team.
"Now I finally have something - contract violation - to put pressure on Flavio. If the FIA world council confirms the case, I will have a hold for going to court."
