THE death of Michael Jackson is to become a MURDER investigation, the News of the World can reveal.

An autopsy on the superstar has shown he died from an injected overdose of heavy-duty painkiller Diprivan.

Police have told his family they will press charges against one or more people within DAYS and there will be a criminal TRIAL.

It could involve whoever administered the injection and anyone who made it available to the star.

Last week La Toya Jackson told the News of the World she knew who had murdered her brother.

Yesterday's astonishing development was revealed by Terry Harvey, a long-time friend of the Jackson family, in an exclusive interview with us.

Terry said: "The autopsy shows that Michael died of a drug overdose with Diprivan and a range of pills in his stomach. He had needle marks on his neck and all over his body.

"The authorities have told the family the Drug Enforcement Administration are pushing for a criminal charge.

"It is likely to be second-degree murder, due to the actions which led to his death. They have been assured that someone, or maybe more than one person, will be brought to trial.

"The family are working with the DEA and Los Angeles Police Department to work out which doctor prescribed Michael these drugs and how far back this serious problem runs."

Terry also revealed that as soon as the murder inquiry is announced the Jacksons intend to SUE AEG, the promoters behind Jacko's planned London O2 comeback shows, for £30million for "wrongful death".

The family, headed by father Joe, say its bosses failed in their duty of care towards Jacko and could have saved his life.

Respected music promoter Terry, currently working with girlband TLC, said: "The family is speaking about whether there is enough evidence to take a private lawsuit against the promoters or the doctors involved.

"Once the criminal charges are announced, the family will file for a wrongful death lawsuit.

"Joe Jackson has made no secret of his efforts to step in to get Michael to rehab while he prepared for his London shows. The question is how much did the concert organisers know about his drug problems and who was feeding him the drugs?

"I can see Joe filing a lawsuit against anyone who is found to have caused fatal harm to his beloved son.

"He and the rest of the family are serious about getting to the bottom of his son's death and insists it's foul play. It's no secret that AEG appointed a doctor to look after Michael's welfare."

The company have claimed they did everything they could to help Jacko prepare for the 50-date tour. AEG's representatives have always insisted Jacko was fit, healthy and in "great shape" during his rehearsals.

Terry is also the first member of Jackson's inner-circle to confirm the star's horrendous, long-term addiction to prescription drugs.

He said Jacko died a JUNKIE thanks to daily injections of Diprivan (or Propofol) and another painkiller Vistaril, plus swallowing a cocktail of pills including anxiety drug Xanax, anti-depressants Prozac and Zoloft and anti-indigestion drug Prilosec.

Terry added: "Michael had a long-term drug habit. He was no different to a drug addict living in a crack house. What he wanted was served up to him. He didn't go to the stores to get his fix, it was brought to him. He started in 1984 after he got burned filming that Pepsi advert. But in recent years it spiralled out of control and he was even self-injecting.

"By the end he knew how to administer these drugs himself as he had so much medical knowledge. Now he's dead everyone is washing their hands of it. I don't believe that Michael injected himself in the neck though.

"The jury is out on everyone in his inner circle. I believe some of them actually got him drugs. These people should be thrown into jail."

Last night leading pathologist Dr Cyril Wecht backed Terry's claim that the case will become criminal.

Dr Wecht, who worked on the Anna Nicole Smith drug case, said: "If Diprivan was given to Michael Jackson, prescribed by some physician, and it was administered by him or anybody else at his home then it goes beyond negligence. The drugs need to be administered by a trained anaesthetist. It is to be given only in a hospital setting because it is susceptible to bacterial contamination.

"For all of these reasons, if any doctor prescribed Propofol for Michael Jackson to take at home himself that is gross wanton negligence which, as I understand it, is manslaughter."

Terry, who is friends with Joe Jackson and Michael's brother Tito, got close to the star's aides in his final days after agreeing to promote a one-off Jackson 5 reunion in 2010. And he is adamant that Michael needed to go to rehab before returning to the stage in London this month and begged 50-year-old Jacko's associates to let him step in.

Terry, 49, said: "I told them Michael had a drug problem. I said we need to 'get him off the junk'.

"They said my concerns were meritless and changed the subject. I didn't hear a word afterwards."

Terry told how Jacko's dad tried to get Michael to go to rehab in March.

He said: "Joe wanted to get his son cleaned up as he was so keen to do the family show deal for 2010.

"He knew he wasn't ready for these summer shows in London. Joe called him on the phone and said to Michael, 'Let's get it together. Let us help you and clean the house'. Michael said 'OK' to appease his dad but he didn't even take his words in. By that stage he was an addict.

"He still thought he was the biggest star in the world. He did what he wanted. He felt he wasn't ready to go.

"Joe went to the house at least three times to intervene, but couldn't get through to his son."

Concerned Terry even offered to take care of Jacko. He said: "I begged Joe to get me into the house. I wanted to fight off all the enablers and keep them away.

"We had suspicions who was getting him prescription pills, but it was important to stop it first and deal with them later.

"MJ needed to be looked after one-on-one. Aside from the drugs Michael knew that these shows were too much for him. He needed the money, but it was all too much too soon. I knew in his heart he didn't want to and more importantly couldn't do these shows."

Terry told how Jacko called him after the O2 shows were announced.

He said: "Michael came on the phone and said, 'I only signed up for 10 shows. I didn't sign for 50. You are gonna have to rearrange the schedule to two shows a week.' Michael could only do two shows a week due to the strain on his voice let alone the physical stress of doing two hours on stage."

Two weeks ago AEG boss Randy Phillips told the News Of The World Jacko was lazy and had turned up for just two weeks of the four months of rehearsals.

But Terry said: "The TV has been showing clips of his rehearsals and from what I can see Michael wasn't even singing live.

"He was struggling with his dance moves. I was told he had his vocals sequenced on stage so if he didn't want to sing live they just switched on the tape."

Days before his death Jackson postponed his 02 debut from July 8 to July 13 blaming the "size and scope" of the production.

Terry added: "Michael knew he had to do these shows as he was in so much debt.

"The concert company put a lot up front and wanted to get a return on their money. The shows and the pressure got bigger than he could handle.

"Michael pushed himself to the edge as he didn't want to let the fans down."

I am studying forensics and criminology and I had this case sussed out within minutes of been told that Mr. Jackson was in the hospital; unaware of his fate, I suggested that if the pathologist did his job right; he would find a substantial amount of needle marks; and be able to determine the time of which Mr. Jackson received the injections. I also suggested that the motivation which is the key motivations in murders is money... now they say the doctor who is key in the investigation; was in debt...

To pursue a full murder charge; forensics needs to be able to back up traditional detective work.
To pursue a manslaughter charge; as per above but to be able to prove that Mr. Jackson had authorized the intravenous injection but was without full knowledge of the strong side effect it could have on him; a doctor would have the knowledge and if he did not present it - then it's a case of manslaughter
To pursue misadventure charge; as per above but the doctor would need substantial allies and taped conversations whereby Mr. Jackson is heard to say "I don't care what effect this drug has on me; I want it anyway..." if the doctor can prove that, it's misadventure; but he is still liable for criminal charges based on the fact that he could have preveneted the death of Mr. Jackson but did nothing; and to flee the scene when he was needed was both inappropriate and suspect.

oh poor michael your death and your life was all confusing, SOME people loved you becoz of your money but MOST people loved you becoz you was so inoncent. Your passing had left me in tears Michael...I froze in sadness and felt so lost in agony learning that I will never ever see you dance and sing again as I once witnessed when you were here in 97. You really took my breath away and totally make us all here so out of this world...It is such a huge loss for me who hv been watching you moonwalk, and been growing up expressing myself with your 'beat it', 'billie jean'... thriller and all... Thank you so much Dear Michael for making my teenage years so colorful and filled with sweet memories...since then you had become part of my life..

Your sudden departure broke my heart in pieces...as if I've lost my own family member. ...But you know what ...it may sounds strange but your passing had somehow opened my eyes about...WHEN IS MY CALL COMING ? Why o WHY is this becoming a hunt for manslaughter?

This is becoming CRAZY.

The man was an addict, one of the richest/poorest men on the planet. He knew the cocktail of death he was taking. Its strange how his family now all too late are saying how they knew of his addiction.

MJ sadly was a time bomb slowly ticking down to a countdown timer.

Jackson was one of the most talented pop artists of our time. But like many others sadly flawed by his life.

Let him rest in peace and celebrate the man for the music.

Diprivan (Profofol) is not a pain killer as stated in this article. It is an anesthetic that is short acting and leaves the body very quickly. It is only used in the operating theatre under close supervision.

The autopsy information is said to have shown how emaciated Jackson was...yet he was performing energetically!! Is there something wrong with this picture??
Could it be that he was taking stimulant drugs to perform and sleeping pills and pain killers to rest?? He was an adult. No one should be charged with his murder. He did this to himself.

It is frightening the amount of wing-nuts out there who fed on Jackson's lies and subterfuge. Jacko wasn't right in the head and, as could be rightly argued, was a bit of a deviant.

What I find amazing is that people fawn over his passing, much like that of Jade Goody / lady Diana [tug forelock], yet would not exhibit the same degree of emotion at the death of a close relative.

I don't think this man cares about Michael :/ and I certainly don't think Joseph does.
I also don't think Michael was a junkie I believe he was given these drugs, by the sick people who wanted the money, and just thought he was meant to take them and therefore did.. I dunno but I do know if people REALLY cared about him he wouldn't be dead right now.. :(

I was 14 years old when I first heard Michael Jacksons song I want you back. Me and my family were amazed at Michaels's incredible talent at the age of ten!! We fell in love with him then. He was a beautiful talented young boy. We listened to a few more of his songs such as Ben and we were still amazed. Years went by and still Michael amazed us with his singing and dancing talent. He continuedf to amaze us with Thriller and by then then his awsome presece

micheal jackson was a amazing and talented man. his death was tragic and a horrible way to die.

but i think it is disgusting how the whole world even in death will not leave him alone. the poor man has gone and no one is letting him be at peace for once in his entire life.

and as for his children they should be able to grow up like any other child and not be used to gain on someone elses behalf.

I hope that the cops, coroners and the prosecutors do everything in their power to solve this case, cause this case breaks my heart. Doctors are NOT allowed to prescribe or give anesthesia Propofol to people at their homes, it has to be given in a hospital nearby resuscitation equipment on account of that death is one of the side effects, period. I will miss MJ forever.

Joe Jackson's "beloved son"? He abused him as a child, which led to many of his problems in the first place.

Someone should have encouraged Michael Jackson to say no to all those shows, no matter the debt. They knew he was an addict, and undernourished to boot.

Btw, Diprivan is not a painkiller, is a sedative that decreases the absorption of oxygen. It's extremely dangerous, especially if you are already in bad shape.

getting real tired of everybody making Michael Jackson into the cliched dead rock star saint. He was probably the greatest showman on stage, had a great voice, and excellent songs written for him - all true. Was he a genius? no.. he was an entertainer, and a soiled one at that. Its not for nothing that everybody refered to him as "wako jacko" rather than "the king of pop" over the last decade..so it makes me cringe seeing all the press falling over themselves to flatter him now that he's passed when they spent over 10years destroying him.

Ofcourse theres the old saying "theres no smoke without fire". Lets not suddenly forget that he was charged with child abuse TWICE.. and that he settled out of court for the sum of a reported 14million with the first one. Jacko may of been "child-like" and nieve but theres no doubt he would of paid off the childs family on the advice of his expensive lawyers for a reason.

lets have a bit of sanity this guy was not a saint, what he did contributed to his death ,his life in other ways as far as kids were concerned was at best questionable, other people have had a worst life and still behave in a reasonible way,and his career was on the way out the only reason there was a run on his records was mass hysteria

The death of this great talented man Jackson is a mystery which is going to go on for ages trying to know who the real killer is.Whatoever the case, people should thank God that they lived to see one of his perfect creations that the world loved dearly and yet those near him loved him for his money.

I have grown up listening to his music and his songs and talented ignited a fire that will never go down in human history, that is no one not even close will someone ever take the place Jackson had in people's hearts.

Its so saddening to hear all the bad things that people said about him, and it hurts so much that even after his deaths, there is a couple of bafoons who are still talking ill of MJ, please have some shame on ya face and heart, and respect the dead for i dont think u would love it when u r up in the starts (if u will be there) to hear people talk ill of you

Poor Micharl Jackson, he never had a chance. He was a child of horrible abuse by his father, was the family meal ticket. He was stunted in growing into a man. He was so child like, loving and not looking for the bad in people. The only person, I ever heard talk about in a negative way was Joe Jackson. From a family of abuse, it never goes away. Not all the money in the world can erase those horrible memories. No one but Joe Jackson is responsible for the sad death of Michael Jackson. Now he finally has peace, joy and is out of pain. Any monies from the death of MJ should be put in a trust for the children. Joe Jackson should not make one cent on the demise of his biological son, he was and still is proofing he is not a father. He is a criminal!!

We are ALL guilty of the death of Michael Jackson. We, the public, place these people on a pedestal. We then demand them to live up to a level of expectation which is wholly impossible. It is the strain and pressure of our desires that brought about the premature death of this talented performer. Perhaps, in future, we should recognise that these 'celebrities' are indeed just people, such as you and I.

Each time i hear stories about MJ my heart bleeds. For God's sake let's allow his gentle soul to rest in peace. It is the duty of a good father, mother, brother and sister, even friends to care for their love ones, but in MJ case really i don't really know what to say, it is very unfortunate.

Whats the point of charging some one now for his murder as what ever happens MJ is never coming back to life.

The evil low lifes who did this to him should have been stopped earlier on in time and MJ would not have died. He had many good years a head of him but now all that has been taken away.

Every one close to MJ must have known he was in a very vulnerable position and although people close to MJ may have had their suspicions no one did a thing to remove MJ from that danger and help him.

I agree with Flo that is what seems to have happened that the dr administered this but didn't monitor MJ condition. This could have been totally avoidable. Why didn't he encourage him to get help for chronic insomnia instead of this, MJ wanted to get his rest for the concerts. In his concerts he danced throughout and never gave duff notes he was a perfectionist. Who turned a blind eye in the camp? instead of get help for his addiction.

Some months ago I had a major op with heavy anesthesia, plus intravenous pain killer during the op and after. To say I felt like a zombie is an understatement, and couldn't wait to get back to "normal". For six months I lost my appetite, sense of taste, sense of smell, and could not bear the ghastly smell of a normal family meal being cooked, I could go on. So I know the symtoms and side effects MJ would have experienced, and I only had possibly two or three drugs to contend with. There were medical experts with MJ who would see in an instant the state he was in, and didn't lift a finger to help, until it was too late. An intelligent well read man, with his own finger on the self distruct button for years, it was only a matter of time, like many troubled stars gone before him, sad but true. Rest with our spiritual love Micheal, gone but not forgotten.

I think people are forgetting Michael Jackson took these drugs knowing the side effects, he had been taking them for years, it was enevitable because he become so hooked on them. Why a murder case or even manslaughter it was his own fault, he could have been getting these drugs unknowingly by different doctors or other sources, I think this is wrong to be a murder charge, michael jackson took his life into his own hands everytime he took these drugs, he may have been a great performer but come on guys. Elvis didnt have all this and he died the same way.... Everyone would like to think he was a saint but hes the one to blame no one else he took his life in his own hands dont go blaming the professionals thats far tooooo easy.

Michael was most likely put under alot of pressure yet again by his father to do a Jackson 5 reunion. His dad probably saw the opportunity to emotionally blackmail him considering that hed agreed to do the O2 shows. I myself had a very abusive mother and even to this day when she wants me to do something, ill do exactly the opposite, even if it means cutting my nose off to spite my face. I can understand exactly where Michael is coming from and Im glad that he is finally out of all this hurt and pain. I realise that some people make mistake as parents but those scars that a child carries usually get deeper the older they get. RIP MJ.

Sue AEG - His Father should be looking to sue himself. He abused his position and his son to fulfill his own dreams. His abuse contributed to a mentally ill son who has obviously been sick for many years. Strange that only now he wants to do something about it. Could it be because there is a chance of getting even richer from him. Even if true AEG only did what he has done for the past 50 years. Oh please, everyone knew he was a junkie, ok a RICH junkie, but a junkie none the less. Everyone knew what he had to have, the Dr would have had a choice: Do I cross the line, or don't I. He possibly justified it knowing that he could earn some $ and could rely upon the Dr v patient relationship and the sealed files, alas when Jackson was asked if he had 'self medicated' that day, he would have said Yes\No, at which point the Dr made a choice!
So SHOW TRIAL! Jacksons put some money in the family pot, jacksons get some contracts to tell their side of the story and the possibility of an our of court settlement from AEG as they knowing hired a drug user and knew this could have happened. Everyone gets a little richer, possibly blaming MJ for his own demise afterall he had 'some medical knowledge' he was 'intelligent and read a lot' so combining that with his own care, it's not too far a strech to imagine he knew how to stick himself and saying 'No I've not had any drugs today Dr' would likely mean no consequences, maybe a bit of a buzz. But no, today, it caught up with him and he paid the price. Dr will get off with a little tarnished relationship, but then what else could he have done. Like I say, Jacksons get rich again!

The Kids need to be removed from that family, but the Jacksons including the sisters will fight for them, as they will inherit BIG from all MJ's music and they will NOT lose control of that pot!

Just to put this in context, imagine you've closed your physician practice and signed on to be Michael Jackson's personal doctor. All of the sudden you are an employee of your patient, who is a wealthy drug addict. He likely demands you feed him these various drugs or you're fired, and you now have nothing to quickly fall back on.

Michael knew hiring this guy after he closed his practice would put him in a position of power to gain access to drugs, the high salary serving as a form of financial blackmail. The idea that someone put in this financially compromised position should be charged w/ murder is laughable. There has to be personal responsibility on MJ's part.

it would appear that it was in a lot of peoples interest to keep mj medicated. a lot of hangers on and members of the medical profession surrounding mj have been making a very nice living by supplying and administering drugs that have in effect kept him sedated and in my medically untrained opinion the drugs that were used to sedate mj and the drugs to wake him up enough to rehearse led to his body giving out with a build up of the anesthetics in his body. it would be like having anasthetic every day, it doesn't bare thinking about. how doctors can do this is beyond me but then they say that everyone has their price. mj is just the late in a long line of stars who drugs have claimed either by accident or purposefully, maralyn monroe, judy garland to name just two.
