The ex-Rangers winger has asked boss George Burley NOT to pick him as he can now only see his son on weeks set aside for international ties.
And that explains why he wasn't in the Scots squad for yesterday's 2-0 defeat in Japan.
Burke, 25, proposed to sweetheart Jennifer last July after she gave birth to their son. But their relationship turned sour after he left Ibrox in January for English Championship side Cardiff.
He said: "It's been a very difficult time. My partner won't let my son come to Wales, so the only way I can see him is to go to Glasgow.
"I'm getting stopped from playing for my international team - but getting to see my son is the main thing."
Burke, who won two Scotland caps in 2006, played 131 times for Rangers between 2002 and 2008. Last month we told how his Cardiff City team-mate Ross McCormack was called "heartless" by HIS ex for snubbing their son.
Lesley Ann Melvin, 24, said the former Gers star had only seen two- year-old Hayden once in 16 months.
But the Scotland ace insisted: "I'm desperate for Hayden to visit but I get very little time off."

That comment was a bit harsh, chris burke is obviuosly a great dad putting his scotland career on hold to come to glasgow and see his son.
