Debbie-the mother of Prince Michael, 12, and Paris, 11-agreed three-times-a-year visits and a cash deal to give Jackson full custody in 2006.
Jackson's mum Katherine is temporary guardian of the two children and Jacko's son Blanket, seven, by an unidentified surrogate mother.
A custody hearing is scheduled for August 3, but former Jacko aide Stuart Backerman insisted a deal would be struck out of court.
Mr Backerman said: "My belief is that Debbie Rowe will not contest the custody of the children. The only possible thing which would be pushing her is that she feels that Katherine at 79 may not be able to raise the kids for much longer or how long she'll live.
"The family want her to finally take a back seat. Debbie signed off parental authority and custodial authority to Michael a while ago but she may be yearning for more of a role with the kids."
A Jackson family lawyer said Katherine and Debbie have been working to "privately and amicably resolve" the custody issue.

It was my greatest desire to meet u Jackson ones in my life.You shocked me.I was not ready to say goodbyeto you like this.Come back Michael.How could God be so bitter that he snached such great personality so soon,it was not the right time to departure.I am still crying for u.I love u MJ and will love u till I am..............

It was obvious that Michael was not fit enough to do all those 50 shows, whoever arranged that must have been potty, the prospect of having to do all those shows must have been a tremedous worry to Michael. Its so sad a great talent lost!...
